1. General Information and Definitions

BEMAGRO INTEGRAÇÃO E DESENVOLVIMENTO S.A., hereinafter referred to simply as BemAgro, registered under CNPJ/MF No. 07.593.560/0001-46, as the Data Controller, is bound by the provisions of this Privacy Policy.

LEGAL BASIS: the legal foundation that legitimizes the processing of personal data for a specific purpose by BemAgro, as defined in the General Data Protection Law.

CONSENT: a legal basis involving the explicit and unequivocal authorization from the Data Subject for the processing of personal data by BemAgro.

PERSONAL DATA: any data from which information can be extracted, whether isolated or combined, that (i) identifies a Data Subject; and/or (ii) from which the identification or contact information of a Data Subject can be derived.

PURPOSE: the purpose for which BemAgro performs the Processing of Personal Data.

PRIVACY POLICY: this document, which contains BemAgro’s guidelines for the Processing of Personal Data.

PROCESSING: any operation performed with Personal Data, such as collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation, control, modification, communication, transfer, dissemination, or extraction.

NECESSITY: the justification for which BemAgro processes Personal Data.

PRODUCTS/SERVICES: all events, websites, products, and/or services managed, maintained, created, or marketed by BemAgro, including but not limited to its websites, blogs, BemAgro platform, webinars, training sessions, live streams, etc.

DATA SUBJECT: natural person whose Personal Data is processed by BemAgro.

USER: natural person of at least 18 years old, in full use of their mental capacity, who uses BemAgro’s products/services.

By accessing and/or using BemAgro’s products/services, the user declares to be at least 18 years old and to have full capacity to accept the terms and conditions of this Privacy Policy for all legal purposes.

If the user does not meet the above description and/or does not agree, even in part, with the terms and conditions contained in this Privacy Policy, they should not access and/or use any products/services offered by BemAgro.

At BemAgro, privacy and security are priorities, and we are committed to transparency in the processing of our users’ and clients’ personal data. Therefore, this Privacy Policy establishes how the collection, use, and transfer of customer or other individuals’ information who access or use our website is conducted.

By using our services, you understand that we will collect and use your personal information as described in this Policy, under the rules of Data Protection (LGPD, Federal Law 13.709/2018), the consumer provisions of Federal Law 8078/1990, and other applicable Brazilian legal norms.

2.1 What data do we collect about you and for what purpose?

BemAgro ensures its users/clients their rights as Data Subjects under Article 18 of the General Data Protection Law. Thus, you may, at any time and free of charge:

  • Confirm the existence of data processing, in a simplified or clear and complete format.
  • Access your data, which can be requested in a readable copy in print or electronic form, secure and suitable.
  • Correct your data, by requesting the editing, correction, or updating of these.
  • Limit your data when unnecessary, excessive, or processed in non-compliance with the legislation through anonymization, blocking, or elimination.
  • Request the portability of your data through a data portability report that BemAgro treats about you.
  • Delete your data processed based on your consent, except in the cases provided by law.
  • Revoke your consent, disallowing the processing of your data.
  • Be informed about the possibility of not providing your consent and about the consequences of the refusal.
 

5. How can you exercise your rights as a Data Subject?

To ensure your correct identification as the personal data subject of the request, we may ask for documents or other proofs that can prove your identity. In such a case, you will be informed in advance.

 

 

6. How and for how long will your data be stored?

Your personal data collected by BemAgro will be used and stored for as long as necessary for the provision of the service or to meet the purposes outlined in this Privacy Policy, considering the rights of the data subjects and the controllers.

Generally, your data will be maintained while the contractual relationship between you and BemAgro lasts. After the storage period of the personal data, they will be deleted from our databases or anonymized, except for the cases legally provided in Article 16 of the General Data Protection Law, namely:

I – compliance with a legal or regulatory obligation by the controller;
II – study by a research body, guaranteed, whenever possible, the anonymization of personal data;
III – transfer to a third party, provided that the data processing requirements set forth in this Law are respected; or
IV – exclusive use of the controller, prohibited its access by a third party, and provided that the data is anonymized.

That is, personal information about you that is essential for compliance with legal, judicial, and administrative determinations and/or for exercising the right of defense in judicial and administrative processes will be maintained, despite the deletion of other data.

The storage of data collected by BemAgro reflects our commitment to the security and privacy of your data. We employ technical protection measures and solutions capable of ensuring the confidentiality, integrity, and inviolability of your data. Additionally, we also have appropriate security measures for the risks and access control to stored information.

 

 

7. What do we do to keep your data secure?

To keep your personal information secure, we use physical, electronic, and managerial tools oriented to protect your privacy.

We apply these tools considering the nature of the personal data collected, the context and purpose of the processing, and the risks that possible violations would generate for the rights and freedoms of the data subject collected and processed.

Among the measures we adopt, we highlight the following:

  • Access to your personal data is made only after the commitment to confidentiality.
  • Your personal data is stored in a secure and appropriate environment.

BemAgro is committed to adopting the best postures to avoid security incidents. However, it is necessary to highlight that no virtual page is entirely safe and free from risks. It is possible that, despite all our security protocols, problems exclusively due to third parties occur, such as cyber-attacks by hackers, or also due to the negligence or imprudence of the user/client.

In case of security incidents that may generate relevant risk or damage to you or any of our users/clients, we will communicate the affected parties and the National Data Protection Authority about the occurrence, in accordance with the provisions of the General Data Protection Law.

 

 

8. With whom can your data be shared?

In view of preserving your privacy, BemAgro will not share your personal data with any unauthorized third party.

Your data may be shared with our commercial partners. They receive your data only to the extent necessary for the provision of the contracted services, and our contracts are guided by the data protection standards of Brazilian legal regulations.

However, our partners have their own Privacy Policies, which may differ from this one. We recommend reading these documents.

Additionally, there are other cases in which your data may be shared, which are:

I – Legal requirement, request, requisition, or court order, with competent judicial, administrative, or governmental authorities.
II – In case of corporate transactions, such as merger, acquisition, and incorporation, automatically.
III – Protection of BemAgro’s rights in any conflict, including those of a judicial nature.

8.1. International Data Transfer

Some of the third parties with whom we share your data may be located or have facilities located in foreign countries. In these conditions, in any case, your personal data will be subject to the General Data Protection Law and other Brazilian data protection legislations.

In this sense, BemAgro is committed to always adopting efficient standards of cybersecurity and data protection, in the best efforts to ensure and comply with legislative requirements.

By agreeing to this Privacy Policy, you agree to this sharing, which will take place in accordance with the purposes described in this document.

BemAgro uses Cookies, which are text files sent by the platform to your computer and stored there, containing information related to site navigation. In summary, Cookies are used to improve the user experience.

BemAgro provides for the responsibility of agents who act in the data processing processes, in accordance with Articles 42 to 45 of the General Data Protection Law.

We undertake to keep this Privacy Policy updated, observing its provisions and ensuring its compliance.

In addition, we also commit to seeking technical and organizational conditions that are safely able to protect the entire data processing process.

If the National Data Protection Authority requires the adoption of measures in relation to the data processing conducted by BemAgro, we undertake to follow them.

11.1 Disclaimer of Liability

As mentioned in Topic 6, although we adopt high security standards to prevent incidents, no virtual page is entirely risk-free. In this regard, BemAgro is not responsible for:

I – Any consequences arising from users’ negligence, imprudence, or lack of skill regarding their individual data. We guarantee and are responsible only for the security of data processing procedures and for fulfilling the purposes described in this document.

We emphasize that the responsibility for maintaining the confidentiality of access data lies with the user.

II – Malicious actions by third parties, such as hacker attacks, except in cases of proven culpable or deliberate conduct by BemAgro.

We emphasize that in case of security incidents that may generate significant risk or damage to you or any of our users/customers, we will inform the affected parties and the National Data Protection Authority about the occurrence and will take the necessary measures.

III – Inaccuracy of the information entered by the user/customer in the records required for using BemAgro’s services; any consequences arising from false or maliciously entered information are the sole responsibility of the user/customer.
